In these Terms & Conditions, the following definitions shall apply unless the context otherwise requires:

• "ph38," "we," "us," or "our" refers to the operator of the ph38 online gaming platform accessible at ph38.one and its associated subdomains.
• "Platform" means the ph38 website, mobile web application, software, content, and all associated services made available by ph38.

Each individual may hold only one Account on the ph38 Platform. Attempting to create multiple Accounts — whether under the same or different identities — constitutes a material breach of these Terms & Conditions. ph38 employs technical and manual methods to detect duplicate accounts. Where duplicate accounts are identified, all associated accounts may be permanently closed and balances forfeited.

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify ph38 immediately via live chat support if you become aware of any unauthorized access to or use of your Account. ph38 will not be liable for any loss or damage arising from your failure to keep your login credentials secure. ph38 will never ask for your password via any communication channel.

ph38 reserves the right to require identity verification (KYC) at any time. KYC verification is mandatory for all withdrawal requests above certain thresholds, and ph38 may request it at account creation or upon review of account activity. Requested KYC documents may include a government-issued photo ID, proof of address, and source-of-funds documentation. Account activity may be suspended pending completion of KYC. Failure to provide requested documentation within the specified timeframe may result in account closure.

ph38 accepts deposits via GCash, Maya, BPI, BDO, Metrobank, 7-Eleven CLiQQ, and USDT. All deposits are credited in Philippine Peso (PHP). USDT deposits are converted to PHP at the prevailing exchange rate at the time of deposit. ph38 reserves the right to add or remove payment methods at its discretion. The minimum deposit amount is PHP 100 unless otherwise specified in a current promotion.

GCash and Maya deposits typically credit to your ph38 Account within seconds of successful transfer confirmation. Bank transfers and 7-Eleven CLiQQ deposits may take longer depending on the payment provider's processing time. ph38 is not responsible for delays caused by third-party payment processors. All deposits are final and cannot be reversed once credited to your ph38 Balance.

Withdrawals may be made to the same payment method used for deposits, subject to applicable limits. Withdrawals to GCash and Maya are processed within the timeframes stated in the ph38 Cashier. Withdrawals exceeding applicable thresholds require completed KYC verification. ph38 reserves the right to conduct enhanced due diligence on withdrawal requests and may request additional documentation where required by applicable anti-money-laundering obligations.

All transactions on the ph38 Platform are denominated in Philippine Peso. ph38 does not charge deposit or withdrawal processing fees for standard transactions; however, your bank or payment provider may impose their own fees, for which ph38 bears no responsibility.

An Account that has not recorded any login or transaction activity for twelve (12) consecutive months may be classified as dormant. ph38 will make reasonable efforts to notify the Player prior to classifying an Account as dormant. All bonuses and promotional offers made available by ph38 — including but not limited to the Welcome Bonus, Daily Cashback, Weekend Reload, and Referral Bonus — are subject to specific terms and conditions published alongside each promotion. In the event of any conflict between a promotion's specific terms and these general Terms & Conditions, the promotion-specific terms shall prevail with respect to that promotion.

Bonus Funds credited to your Account are subject to wagering requirements, which specify the total amount of wagers you must place before Bonus Funds and associated winnings become eligible for withdrawal. Accounts found to be engaged in bonus abuse will have all bonus balances and associated winnings forfeited. ph38 reserves the right to void any bonus at its sole discretion where it determines abuse has occurred.

ph38 reserves the right to modify, suspend, or terminate any promotion at any time without prior notice. Changes will not affect bonuses already credited to a Player's Account under the original promotion terms, unless the promotion was activated fraudulently.

Each game category on the ph38 Platform — including live dealer casino, slot games, fish shooting, bingo, and sports betting — is governed by its own game-specific rules accessible within the respective game or game lobby. Players are responsible for familiarizing themselves with the applicable rules before placing wagers. ph38 is not responsible for losses arising from a Player's misunderstanding of game rules.

ph38 reserves the right to void sports bets placed on events that are subsequently cancelled, postponed beyond the applicable settlement timeframe, or affected by circumstances making the original odds materially incorrect at the time of placement. The following conduct is strictly prohibited on the ph38 Platform:

• ph38 shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Platform.
• ph38 does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. Access to the Platform may be suspended for maintenance, security review, or circumstances beyond ph38's reasonable control.
• ph38 is not liable for losses arising from a Player's failure to comply with these Terms & Conditions, or from a Player's own negligence or misconduct.

Nothing in these Terms & Conditions limits or excludes liability for death or personal injury caused by ph38's negligence, fraud, or any other liability that cannot be excluded by law.

ph38 collects, processes, and stores personal data in accordance with its Privacy Policy, which is incorporated by reference into these Terms & Conditions and forms part of the binding agreement between you and ph38. By accepting these Terms & Conditions, you also accept the ph38 Privacy Policy.

ph38 processes personal data for purposes including account management, identity verification, fraud prevention, regulatory compliance, customer support, and marketing communications (where you have provided consent). ph38 does not sell personal data to third parties. You may close your ph38 Account at any time by contacting live chat support. Upon Account closure, any Real Money Balance remaining in your Account will be returned to you subject to completion of any pending KYC requirements and applicable anti-money-laundering checks. Accounts closed while subject to an active self-exclusion request will not be reopened during the exclusion period.

ph38 reserves the right to suspend or permanently close any Account at its sole discretion, with or without prior notice, in circumstances including but not limited to: breach of these Terms & Conditions; suspected fraud or money laundering activity; failure to complete required KYC verification within a reasonable timeframe; or conduct harmful to the integrity of the Platform or other Players. Your continued use of the ph38 Platform after any amendment to these Terms & Conditions becomes effective constitutes your acceptance of the amended terms. If you do not agree with any amended terms, you should cease using the Platform and may close your Account in accordance with Section 12.1.

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the appropriate courts and tribunals of the Philippines.

If the matter cannot be resolved through the internal process, the dispute may be escalated to the relevant Philippine regulatory or adjudicatory body in accordance with applicable law.

If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
